Small businesses in New South Wales have been caught off guard by the stricter regulations imposed on electric bikes, effective since February. The State Government’s move to enhance standards for e-bikes followed safety concerns related to lithium batteries, which have been linked to fires involving e-bikes and e-scooters. The legislation, introduced mid-2024 and implemented in 2025, aims to mitigate risks associated with these batteries.

One such business owner affected by these regulations is Steve Kimber, who runs an e-bike hire service as part of his Nambucca Heads newsagency business. Kimber expressed surprise at the sudden imposition of these rules, highlighting the lack of prior communication on the matter. Despite his initial concerns, investigations revealed that his fleet of eight e-bikes had already met the new safety standards.

Since the introduction of e-bikes for hire at Nambucca Newsagency in 2021, these electric vehicles have gained popularity among tourists visiting the area. However, Kimber’s recent encounter with NSW Fair Trading alerted him to the need for certification of his existing e-bikes, batteries, and chargers to comply with the updated regulations.

Collaborating with News Of The Area (NOTA), Kimber reached out to the overseas supplier of his e-bikes to secure the necessary certifications for his fleet. Despite the initial inconvenience, Kimber expressed relief that his bikes met the required standards, emphasizing the importance of adhering to quality and safety protocols in the industry.
According to Fair Trading NSW, the revised standards for e-bikes were established in consultation with the industry in 2024, with a focus on enhancing safety measures. While these regulations are expected to have a minimal impact on compliant businesses, sellers of substandard or non-compliant products will need to adjust their supply chains to meet the new requirements.

Amid concerns over battery-related incidents involving micromobility devices like e-bikes and e-scooters, NSW Fire and Rescue reported several fires in 2025 attributed to these devices. Factors contributing to such incidents include improper use of charging equipment, unauthorized modifications to devices, and the use of low-quality components.

Despite the convenience and eco-friendly nature of e-bikes, the risks associated with lithium-ion batteries underscore the importance of adhering to safety standards and proper charging practices. The enforcement of stricter regulations aims to safeguard consumers and businesses alike in the burgeoning electric bike market.
